This Mobile App License (the "License") is entered into between you (the "User") and [RAZÓN SOCIAL], S.A.P.I. de C.V. ("waydot") and governs the use of the waydot mobile app (the "App"), available on the Apple and Google app stores. By installing or using the App, you accept this License. If you do not agree to it, do not install the App.
1. Purpose of the App
The App allows field staff of waydot's customers to receive and carry out tickets, follow task lists, capture evidence (photos, signatures and forms), record attendance and breaks, report expenses and safety incidents and communicate with their team, including without an internet connection.
Using the App requires an account provided by your employer or by the company for which you perform your work (the "Customer"). Use of the App is also governed by the Terms of Use and the Acceptable Use Policy.
2. License
waydot grants you a limited, personal, non-exclusive, non-transferable and revocable license to install and use the App on devices you own or control, solely to perform the work assigned to you by the Customer and in accordance with the usage rules of the relevant app store.
You may not copy, modify, decompile, reverse engineer, rent, sublicense or distribute the App, except to the extent expressly permitted by law.
3. Device permissions
The App requests the permissions it needs in order to function. You can review and withdraw them in your device settings, in which case some features will no longer be available:

4. Personal data
The Customer is the controller of the data you record in the App in the course of your work and must have provided you with its privacy notice, including the use of location during working hours. waydot processes that data as processor on the Customer's behalf. To exercise your rights over that data, contact the Customer. waydot's Privacy Notice describes the data we process on our own behalf, such as your sign-in account.
5. Offline operation
The App stores on your device, in encrypted form, the information needed to continue working without signal and synchronizes it when the connection is restored. If you uninstall the App or clear its data before synchronizing, information not yet synchronized may be lost. You are responsible for protecting your device with a screen lock and keeping its operating system up to date.
6. User obligations
You agree not to simulate or falsify your location, not to record attendance or evidence on behalf of another person, not to share your account and not to alter evidence. waydot may detect such conduct and, where applicable, will bring it to the Customer's attention.
7. Updates
waydot may publish updates to fix bugs, improve security or add features. Some earlier versions may stop working, so we recommend keeping automatic updates enabled.
8. Support
waydot provides support for the App through the Customer and at [email protected]. App stores have no obligation to provide support or maintenance for the App.
9. Warranty and liability
The App is provided on the terms agreed between waydot and the Customer. To the extent permitted by law, waydot does not warrant that the App will work without interruption on every device, network or signal condition. This License does not limit any non-waivable rights granted to you by law.
10. Termination
This License ends when the Customer deactivates your account, when the Customer's subscription ends or if you breach this License. On termination, you must stop using the App and may uninstall it.
11. App store terms
If you downloaded the App from Apple's App Store:
- This License is between you and waydot, not Apple Inc. ("Apple"). waydot, not Apple, is solely responsible for the App and its content.
- Apple has no obligation whatsoever to provide any maintenance or support services for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
- waydot, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or privacy legislation.
- waydot, not Apple, is responsible for the investigation, defense, settlement and discharge of any third-party claim that the App or your use of it infringes that third party's intellectual property rights.
- You represent that you are not located in a country subject to a United States Government embargo and are not on any United States Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the App, such as your wireless data service agreement.
- Apple and its subsidiaries are third-party beneficiaries of this License and, upon your acceptance, Apple will have the right to enforce it against you as a third-party beneficiary.
If you downloaded the App from Google Play, Google Play's terms of service also apply.
12. Governing law and contact
